How long does a DUI stay on my driving record? Does it count as a second DUI if I got my first one 10 years ago?
Answer: DUI is a criminal offense and will stay on your criminal record forever. Every DUI you receive throughout your lifetime will be on your record. I recently represented a gentlemen on his 7th DUI, and all prior 6 offenses were in the 1960's, forty years ago. For the purposes of sentencing, the law goes back for 5 years. In other words, if you receive 2 DUI's in the past 5 years, then the sentence will be greater, as required by law.

how about California? i have 3 DUI's last one in 1997..unfortunetley i just got a nother after almost 12 years 01/21/07…will the others count against me what do i do????????? i have really worked hard at my life and i just made a mistake that i wanna fix..
I just don't understand why the drinking laws are so non forgiving when I grew up in the 60's and 70's it was not a big deal to get pulled over for drinking and mind you I don't even drink today just because I don't want to but it seems like our laws are out of control like a runawy train. The majority of people I knew in my younger years drank and believe it or not we all turned out to be pretty good citizens. So! are the laws saying the human body has evolved into something it didn't used to be and therefore we can't put up with anyone drinking and driving like they used to or what. Yes I had family and friends killed by drunk drivers but I also wathced my friends get massacerd in Vietnam and nobody give a damm. So I just think it's time to lighten up and quit making criminals out of good people who happen to have one to many beers on saturday night.
